well this is your time. with eb3 row 2009, you probably are in wait for at least 5 years. Anyway the point is, no country would be stupid enough to stop great talent from coming through to satisfy it's diversity policy. When you are talking about 0.14 million immigrants for a nation of 300 million, that's less than 0.05%. So please take your diversity argument with you and don't let the door hit you on your way out. For this miniscule percentage, the US will lose out on thousands of the best Indian and Chinese engineering/science talent. US's loss, India/China's gain. If this is not an example of an extremely stupid strategic policy then I'm not sure what is.
Oh and by the way, may not be me or you waiting for Indian/Chinese GC's but could be your kid and mine. Let's have this talk again in a decade or two given GDP growth,debt and deficits of US and GDP growths/deficits/market size of India/China.

What's is Frist's motive in trying to trip the McCain - Kennedy or Specter's Markup? What's his point?
Looks like in Congress, each senior senator is a leader of his own and don't tolerate or cannot see eye to eye on more serious work of fellow senators or congressman. The idea is to trip the whole effort to treat illegal immigrants as humans. In Frist and its ilk's opinion, they want the services of illegal (and legal) immigrants, but this great country doesn't want to give any benefits to the illegal aliens in return. It's is so farcical, only the feudal minded Frists' can do it. Many in this country want 'closure' for this and 'closure' for that, but they deny all relief to these illegal aliens. Our goal of relief from retrogression and to increase visa numbers is unfortunately tied to such 'comprehensive bills'.
I want users of this forum to think about it, ruminate on it and write letters to law makers, newspapers etc.

Someone I know was EB3 I Aug 2001. They had filed for I-485 sometime in 2005. They got their GC on 12/22/2008.
Their lawyer filed a Writ of Mandamus against USCIS in Aug 2008. The deal was the USCIS was to either approve or reject their case in 60 days.. So, check with your attorney and see if filing a case in an option for you.

Before I approach Ombudsman is it wise to get any sort of clearence or green signal from your lawyer ? Can you approach them directly without a lawyer ?

Hmm. That looks like the solution to my problem. So If my GC is approved in a month, I go to India myself, get my wife's consular processing done through follow to join route and bring her back together. (Assuming follow to join process takes just a couple of months). If my GC is still pending, then I go to India and bring my wife on a visitor visa, and then apply her I-485 in US.
So the basic message you seem to be giving is that just because my GC is approved, it does not close doors for my wife. She still has 6 months to get going. Right?

Currently where I am working client willing to hire me as a fulltime employee with the same titile and giving me the supporting letter with the same job duties mentioned in my LC (I have added few more technologies it).
Even my attorney says the same, no need to inform CIS - when we get the RFE we will see.
Can you kindly let me know all the documents I need to gather and what I need to request from new employer in order to submit AC21 bunch to CIS.

Based on my receipt numbers and looking up on USCIS website, it appears my AOS application that was sent to NSC has been sent to California Center. I have not seen anybody's case being sent to CSC. Dunno how good or bad it is and whether it sppeds up/delays my EAD processing. Anybody had experience with CSC and got any of EAD/AP/GC approved from CSC.
My daughter's AOS: filed at NSC tranferred to CSC (RN say so) again transferred to TSC (online status: transferred to area Jurisdiction) so are the delays

There are many people who would just run away from effort when doubts are raised and since people of afraid of being punished for just advocating a public policy or writing a letter to congress in the first place. I would request you to not reproduce posts here or on portal that would echo the material the plants fear and doubts among members. When the core group is spending 2-3 hours a day on top of their fulltime job plus the weekends, plus out of pocket expenses on travel to DC, its disheartening when a post on forum scares away sceptical members.

There are ppl who moved 2 or 3 months after getting GC and have got their USC

I went through the entire thread, i did not find any cases of people who had never used AC 21 and who left their employers right after 485 approval.
To be very specific, we need clarification on what the consequences are of leaving the sponsoring employer right after getting the GC esp people who never used AC21 and have been with the sponsoring company for several years before getting the GC.

So do you mean to say that this is allowed in India? I mean polygamy. I never knew that.
Muslims (around 20% minority) have this special law accepted by indian democratic government. In fact persons from muslim community can marry upto 4 wives at a time. However I haven't seen this as a common practice. Not sure if that law is changed recently. I guess No other religion is allowed to do so in india. I remember reading some cases in newspaper where people from different religion have converted just to legally marry more than one persons in india.

I only waited 7 months - so no upsets - even before my GC was filed - i was in US for only about 2 years or so - so no big deal - in those 2 years - my employer did not discriminate in terms of promotions/ pay hikes etc. I had bought a house even before my GC was filed and spouse could work because of my L1 status
- How did immigrationvoice help you during this long wait?
Not Applicable since IV is not really focused (and rightly so) on my GC category
- Would you like to continue your support to immigration voice and help others waiting?
Sure - some of my closest friends are in H1B and i see how the long wait affects them and their families - having said that - i like to make up my mind (rightly or otherwise) about which initiatives are good or bad/ effective or ineffective- so as and when I see initiatives i get excited about like flower campaign, letters to various lawmakers etc- happy to help

GC and Citizenship should not prevent anyone from pursuing their career and personal dreams - if not US - there are other countries where your skills would be welcome. Personally - i have given priority to career and family life ahead of visa issues and rest has automatically fallen into place

Look at it this way -- An additional quota means more regular EB visa's to go around which will help all. Asking to give 20k more GC's for US Graduates will sound more easy on the ears than asking for a general 20k increase.

Trust me. You would see an approval this month. Most of the people who got an LUD on their approved I-140 on 07/13/2008 are seeing their GC approved. Only uncertain people are those who hasn't seen any such light.

The comment about the "Fee Increase" might be partially true. There is surely a surge in number of application for Naturalization, to avoid the few increase... Atleast I know a couple of friends who applied for citizenship....

Urgency of getting a receipt is that once you get the receipt, it means that USCIS has 'accepted' your application and it will not be rejected for lack of initial evidence.
