Have to give American consulates in India the credit that they have outsourced some job to external private companies.
At Indian consulate the story is quite different. There are many who share Pooja's feeling on this subject as being used to dealing with efficient private businesses in US, as soon as you enter the consulate, the sarkari inefficiency hits you like a ton of bricks. Every small screwup looks like a giant under our microscope and each further screwup just frustrates us exponentially.
As per my last visit to SF consulate, bracing for the worst, I got a surprise to find that it was a breeze, mostly because the lady at the counter was more compassionate and accommodating then the prior ones. But the failure is glaringly at the top level where they fail to define and refine the process, proof-read the information on website (list of document is vague and contains repetitions).
To summarize I think good workers can deliver some time, but the team will ultimately be a failure without good management at the top, and we all know the top management is sarkari babus who could care less as they were appointed from the sifarish of the Govt in New Delhi and not on their own merit.

dint had much time to go thro' your responses. but if senior ppl are targetting this fellow( mercies) for this thread, then i beg to differ. because as a member of IV, i have been answering "hadron" posts too at immigration portal.
I think all Mercies is trying to do is help IV out, by preparing answers of such questions which stupid ppl ask, so they can be put to a stop right away. Probably he's drawing your attention to some q's that all of you have answers for, just guide mercies to that post,
but i think all of your remarks have been directed towards merices only as if he's started it all.
i guess we outta stop ppl who are trying to defame this collective effort by giving them one-point answers.

1. contact all your IV friends
2. contact all your friends in the USA (whether or not waiting for GC)
3. talk to your neighbors in your apartment community
4. hand out bills that describe this action item (We need a poster for this purpose)
In each & every case, offer (as the last option) canned letter format to be filled out and signed... you then photocopy it and mail it!

1. Find an employer who is willing to H1 sponsorship.
2. The filing data starts by April 1st I beleive. Check with attorney.
3. Make sure your future employer does all the paper work required to file an H1. Ex. adv etc etc. Do not wait until April as the quota gets over in very short span of time. May be in few days.
4. Make sure you have all the paper work ready by march end and file it on April 1st or 2nd.
5. Check with attorney whether you need stamping to start working. I dont think so, but make sure. If you need a stamping, make proper arrangements to get it stamped. Once all are done, you are ready to rock from OCT 2007.
Time consuming part is finding an employer to do H1 and working with them to all the ground work before April 2007. Good luck.

My I-140 approved from TSC and I-485 submitted to NSC on July 2nd 7:55am. I talked to 2 immigration officer today morning. They informed me my case would be transfered to TSC. I dont know if NSC would receipt my application:confused:

DREAM Act Loses Republican Cosponsor Richard Lugar
WASHINGTON -- Senate Democrats reintroduced the DREAM Act on Wednesday without the co-sponsorship of Sen. Richard Lugar (R-Ind.), who had previously been one of the bill's strongest backers.
The legislation would allow some undocumented young people to become U.S. citizens and has been introduced repeatedly over the years with Lugar and Sen. Dick Durbin (D-Ill.) as the cosponsors. "President Obama's appearance in Texas framed immigration as a divisive election issue instead of attempting a legitimate debate on comprehensive reform," wrote Helmke. "Ridiculing Republicans was clearly a partisan push that effectively stops a productive discussion about comprehensive immigration reform and the DREAM Act before the 2012 election."
In his Tuesday speech at the Mexico-U.S. border, Obama pointed the finger at Republicans for moving the goal posts on immigration reform. The president argued that his administration has gone out of its way to accommodate their requests.
"Maybe they'll say we need a moat. Or alligators in the moat," Obama joked, referring to the GOP. "They'll never be satisfied. And I understand that. That's politics."
Helmke said Lugar's staff told Democrats that the Indiana senator supported the initiative, but he wanted them to work on getting more Republican support. Lugar's spokesman claims that not only did Democrats not do that, but they set up a press conference to announce the reintroduction of the DREAM Act before the Lugar had made his final decision not to cosponsor. Democrats, however, said that it was clear for months that Indiana Republican wasn't going to cosponsor the bill at this time.

You cannot change employer and keep I-140 if you have not filed I-485 yet. You will have to start the GC process anew if you change the jobs now. So wait untill you apply for I-485. Wait 180 more days after that and you are free to change jobs if your new job is same or similar to your current job.
As you started your GC just now, it's OK to switch the employer and start the GC process once again. If your new employer is ready to start GC process and ready to offer good package, go ahead and take. Don't even think about any other things. If you have to pay for your GC, you need to work on the pros,cons and expenses.
As the dates retrogressed so badly, there will not be any difference if your PD changes by couple of months.

That is wishful thinking.I know people with more recent priority dates got cleared in june but it will go back to PD system from now on again,how else can they do it.The reason why (to eveyone's surprise) they made everything current was to clear some of these cases which were filed long ago(I-485) but were stuck due to the retrogression.This is obviously not going to happen again for sometime since they now have hundreds of thousands of more cases.
I think this will happen again but only in the last quarter when USCIS has to utilise all the visa numbers .With the fiasco that happened in July ,there will be a substantial movement in PDs for June 2008 VB or in the last quarter as they will want to approve cases which have been cleared but cant be approved due to PD not being current. So we will see this kind of scenario almost every last quarter. Also there is a high probablity because
1. they would not like to waste visa numbers .
2. USCIS in under the pressure for media to work in a more efficient manner and justify the fee hikes
3. this also happens to make some people from the immigrant community happy ( atleast something is happening rather than nothing is happening)

While talking to some of my friends I found that most of them don't know about it.So the word needs to be spread wider.

Even if I back date my marriage (as advised) , How can I get my future wife to USA?. I cannot get her on depend status as my H1-B (I believe) got canceled on approval of GC.

I am wondering everybody here is throwing stones at small consulting companies, I wonder how these people came to US surely somebody did there H1? right? People are working in big companies HP/Oracle/SAP bla bla.. but I'm sure they are not the ones who brought you guys here. Also the day they'll get their green cards each of these people are going to open similar companies and do the same thing. This is amazing how people forget their past and forget the people who brought them here...I will call you guys thankless....

Dont let people come here and not pay them / treat them as slaves on contract etc. Look at all the postings (go to murthy's web site--you will see many) Employer not paying, etc etc. In such case whats difference between an illegal hotel worker and these mistreated H1bs. I stay in an apartment OK. One day my neighbour (living downstairs) was crying with his wife and a small kid. You want to know the reason--NO PAY FOR 2 MONTHS!!!!. All his hard earned money was finished paying rent, OK and his kid was sick. No money, nobody to ask. His contractor said WAIT, WAIT and nothing else. Having personally seen this situation, I am a little concerned. Why would you be concerned in asking infosys to disclose the usage of H1bs procurred by them?? If its used properly there shouldn't be any issue. Now how microsoft uses the H1b is more transparent. How many of u working for microsoft have had any issues???
