You can revnew your GC after an intial period of 10 years. You are at your free will and wish to remain on your GC. You will be eligible for Naturalization after 5 years. That does not mean that you have to use that oppurtunity.

Regarding the orignal topic, even I have never heard anyone not getting citizenship because of them leaving the GC employer. Personally, I won't wait for six months or even a single day, if I see a better opportunity.

in fact i think this memo is very favourable.
first of all it has some protections for h1b whistle-blowers.
second it formalizes the 27th, Dec, 2005 into the AFM which is much better.
this memo does not say that you cannot make an AC21 portability request based on a pending i-140/i-1485. all it says is that for the portability request to be valid the i-140 should be approved first. in fact it clearly alludes to the Yates memo and says that section 1 from that memo is valid and consistent with this interpretation. so, as far as my understanding goes you can still use AC21 even if your i-140 is pending.
the one thing though i am having a little difficulty understanding is that it says section 20.2(d) of the AFM will be updated with section (1) from the Yates memo. But the updates to the AFM to section 20.2(d) do not include section(1) from the Yates memo. may be i need to wait for the revised AFM to be published!

Yes sir, I do. I am suffering for 8 years now because of all these stupid USCIS rules. They think that by changing name from INS to USCIS things will change. Well, got a news for all, it is in worst shape than ever.

There used to be a time when the ability to apply for I485 even during retrogression. was of the highest priority for IV. Now majority of the IV members (hopefully) belong to post I485 filing group. Now the amount of green cards for employment category, exemptions from quota for family members, US degree holders etc, and country quota may be the higher priority issues if one goes by the numbers.

I and my wife applied for I485(EB3) in July 2007. We both have got our EADs, but not used it.
My H1 is valid till May 2009. I have I140 approved and have got my H1(3 years) till May 2009.
My wife has her own H1b valid till Dec 2008.
We are planning to get divorced. i have applied for Divorce in India in this month (may 2008).
Is there a way I can cancel my 485 application. Because If i get my green card it will be difficult for me to marry girl from India.
My wife has mentioned that she will be applying for Divorce in USA.
Can I withdraw my 485 application and just be on H1 and wait for applying later. I do not care about GC.
i dont mean to give u advice on patch up..but from 485 perspective ..put ur future marriage plans on hold for a short while or atleast until u get ur gc...

If rebuttal evidence is not filed by the employer, the Notice of Intent to Revoke becomes the final decision of the Secretary. I came to US in 1999 and for a month I did not get paid. I switched to another company and they filed me new H1 instead of transfer. From then, every H1 transfer I need to provide lots of documents to attorney and answer several RFE's for each h1 transfer. Being out of status(not illegal) concerend me a lot but now being illegal is the better than being out of status.
Having paid taxes for all the eight years and playing by rules does not help in America. It is so ironical now to see how legal people are digging their way back in time to find a period for which they wanted to be stamped illegal. All these days legals tried to cover up, but they are now PROUD and HAPPY to find such periods. The WORST is the poor fellows who have not even stayed illegal/out of status and played by rules 100%.
GOD BLESS AMERICA. Becoming illlegal is very easy, but if you want to be legal and get the GC, then it this is not the land.

Since your situation is aggravated, your wife can apply for F1 visa and come here. How you want to answer visa questions on DS-156 or date your marriage cert is upto you. But all said and done and whatever the morale police on this board have recommended is not really valid because you will be going through all of this and not these people who are giving other suggestions. I really want to ask all these people who say dont backdate marriage cert or dont get her on F1, are you guys angels and have done nothing wrong in your lives or are you just preaching others not to sin?
I think you may have missed the point. The people who were advising the OP weren't necessarily thinking of themselves as angles or as the moral(!e) police, as you politely put it. ;) They may have additional information about a similar situation and maybe trying to help him make the right decision. If you know somebody who tried to backdate a Marriage certificate and got wrongfooted by the Consulate maybe you would try and advise future applicants to be a bit more careful too. Or maybe not. Anyway, not saying that's the case here, but there maybe more to the replies than you think.

A number of survivors migrated to the US where they met with hostility from local Americans who were scared these foreigners would take away their jobs. This has been going on since 150 years and is not a recent development.
In 1997, unemployment in the US was zero and so no American felt threatened by foreign presence. The sun was shining, the birds were chirping and everything was hunky-dory for new immigrants. However, the situation is considerbly different today with increased outsourcing and brown desis seen everywhere in the US - especially in walmarts.
With all this, it is inevitable that an immigration reform that will put an end to all our woes is not going to happen. However, we can try our best and hopefully expect at least some reprieve in the forthcoming revamp. If not, then we have Bangalore, Hyderabad and Noida where we do not have to spend an average of 2 hours everyday brooding over immigration issues.

My I-140 approved from TSC and I-485 submitted to NSC on July 2nd 7:55am. I talked to 2 immigration officer today morning. They informed me my case would be transfered to TSC. I dont know if NSC would receipt my application:confused:

Looking at the movement of dates for EB3, esp India and China, it's hard to be optimistic of any changes. It's a very wretched position to be in for Indian and Chinese nationality, if they're in EB3. All those who are eligible to port will definitely try to port to EB2 as long as it's available and cut their waiting time. It might be risky and unpredictable, but it's a risk worth taking considering the endless torture in the form of a long wait and zero or little forward movement of dates.
There've been times when I've felt like attempting porting, but am not sure of the reaction of my employer - a big "reputed" company. If they revoke the I-140 in retaliation for using AC-21, then no chance of porting and back to square one. So it's the seemingly endless wait for me just like all others suffering from 2001 onwards. If only I'd not hesitated to take a bold step back in 2003. Too late to lament about that though.
It was very hard to see at least 3-4 of my friends working in very reputed, established companies, not some tinpot startups (I'm almost tempted to name the companies) using labor Sub. And all of them have got their green cards comfortably. Every single one of them.
Their managers pushed for labors subs for them and nobody even objected because it was legal!
And to my best knowledge, my current company didn't do any subs (perhaps because they didn't have layoffs during dot com bust) so I see senior employees in my company badly stuck with EB3. In fact, there are EB3 managers hopelessly stuck whose EB2 employees are in a better position than them. I'm NOT making this up.
Unless you take risks, you won't progress. Calculate your risks and take it. My friend, 2003 is an old PD and you have been stuck for long. You deserve a better deal and a more senior job profile. I agree completely with folks though, that allowing people to retain the old PD is unfair to others waiting and USCIS should grant some intermediate PD. But take it from me, all kinds of unfair practices have been happening. A classic example is July 07.
