Voted a little while ago. The number had crossed 300.
A suggestion. Pass it on to all your friends and colleagues who might be fellow travellers in this EB journey or may know someone who are, and sympathetic to the plight.
I have just done that....and will also call them and ask them to vote.
In the past, your friends may not have responded to such requests to vote or write to senators. Don't be disheartened. Everyone in this mess is suffering. So, keep asking friends nevertheless, to vote and express support.
Best of luck to US all

Take Infopass appointment to relieve your anxiety little bit . I took infopass on Aug 8 to know what is happening to my I-485
Did not know infopass is a cure for anxiety and sleeplessness. Lot of doctors are about to lose their patients :)

This is not to oppose your message - I am just trying to figure out where these arguments comes from because I don't think I believe in this whole fraud thing. AC21 is meant for one to change jobs after working for the original sponsoring company for 180 days. Also, there are no clear guidelines stating that one must inform the USCIS - so what will this fraud be based on? How can one be committing fraud if there are no guidelines to tell you what is considered fraudulent? I think one is fraudulant when one actually violates some set rules etc. I don't think the USCIS can have a basis for suspecting someone of fraud when they don't even have a definition of what may constitute fraud in this case because of the lack of guidelines. Plus, I have never, ever heard of anyone be denied or suspected of anything like this during citizenship, I just don't believe this is a factor AT ALL. I see these comments a lot and they just don't make any sense to me. To me, it is like breaking a law that doesn't exist. And you say one may be "suspected", well, suspicion is just that, suspicion. The USCIS needs to show proof that you intended to be fraudulent and for as long as there are no AC21 guidelines that tell you that you must inform the USCIS upon invoking AC21, the USCIS will not and cannot have a case against you.
The disadvantage of not filing for AC21 is if your AoS is approved with USCIS believing that you will be working for the original petitioner after approval.
That is the disadvantage. USCIS will not know that you intended to port to new employer by invoking AC21 and come the time your apply for Naturalization, USCIS will discover it and may suspect you of fraud.

Similar situation here...applied EAD/AP renewals 1st week of May at NSC for self and spouse. So far only my EAD has been approved, which is pretty much of no use to me since i am on H1B - but employer was paying all costs, so the law firm applied it anyway.
Spouse needs EAD ASAP before expiry, but nothing yet. I want to modify wht u quoted below:
"USCIS won't give u what u want" I think they somehow have an idea of how desperate u r for someting and ur processing/wait time is proportional to your desperation. :-)
E-filed on May 5th, FP on June 6th, no updates since. Concerned as I'm working on EAD and current one expires August 29th.
Paper filed AP in late June, approved already (as per e-mail) even though I only needed it in mid October!!
Just like the the old Stones song... "You can't always get what you want"

Regardless of the incorrect forum to tell about yourself, your story has serious flaws.
you are just telling us your side of a photoshopped story.
Even after you are here illegally, you can correct things and take a legal turn. there are so many cases where people who have overstayed or crossed over illegally, got themselves deported and or brought themselves out of the closet and applied and got their citizenships.
Also, bcos you spent 30 years in the country, you should be given a priority over a kid from your country who kept applying for a green card lottery every year, trying to enter the US legally?
to make matters worse, you stayed illegally in a country and did not follow the rule of law.
1. I am beyond the waiting for my delayed Green-Card and attempting to correct my ilegal status stage. I am not new to immigration, Im true to immigration.
2. I am no longer fighting for my rights. Im OK. Im in my own country with all rights available to me and am offered a Waiver by the U.S. to visit my friends, family and loved ones when I want. Today Im fighting for my USC Immediate Relatives rights from my country. How many of you high&mighty can say that? Probably never will too. Youd have to walk in my shoes and from my view none of you except for 24ps can fit them, though sledge_hammer might have to learn how to walk in them. He/she sounds a lot like me in my smug and cocky drug peddling and trafficking days. Clue, sledge_hammer: The key to expertise does not lie in what you do but in how you do it. Obligating an unrequested personal opinin on someone is quite negligent and incompetent of a professional. But I guess thats whats expected of IV while youre dug in here, hunh? How unfortunate.
3. You who are new to immigration can probably learn a lot from my case if you werent so caught up in your virgin-eared-newbies image. Like anyones going to believe that. Anyone whos anyone already knows all you want is your Green Card or for whatever human right you feel is being overlooked in this life to be acknowledged while youre still alive like me. Lets hope none of you will ever need an individual such as myself to understand your case anytime in the future. God bless you in all your endeveours.

I agree that labor belongs to the company, but I paid all the fee for the same. They can always use that, but they are not supposed to screw up me In this case, they didn't talk to me and told me that my 485 was applied, which turned out to be a lie.
Please tell the name of that employer, so nobody will join that guy.
atleast sent the private message
BTW how you came to know that whether your case filled or not?

After getting the EAD/AP within three months, I don't think our problem is solved already. We will be at certain point in time be in the same situation as the poster above.
Who told you that you will get EAD/AP in three months. Nothing will prevent USCIS to develop backlogs in EAD/AP too now. "Oh there were so many filed in June/July so that we can't process them that fast anymore..."

You guys are doing a great job of higlighting our plight. I have also donated 100$. You guys should probably start a seperate thread for fund raising.
Anyways coming back to creating awarness. I thought somone should create a podcast something like the ones we hear on NPR. The other might take longer and that is to send a documentry to Google current. It a tv station that just airs user created content.
Yes you guys are right not many people are aware of the issue. Up untill a week back I was under the impression (ignorantly blissfull) that the bill being passed in senate is going to reduce the cap.
I think the first step to be treated on par with agriculture workers is to be organized like them.
I have send out personal emails to all my friends and if anyone wants to reuse please feel free.
Hey Buddy,
Take a look at this

Please take the time to register and send a efax (its
quick I did it in less then 5 mins). The five mins
might save us years :) in gettting our green card.

since there are many knowledgeable guys here ..I had another question - is there a law which says how the spillover should take place ? i.e. EB2(W) should go to EB2(I) etc ? I wonder why they don't send the extra visa's to the category that is in the worst position ..EB3 - I in this case ?
Only ROW EB3 spillover can make it to EB3 India and as ROW itself is retrogressed, that will not happen.
However, if you check 2007 assignments, Eb3 India got over 10K visas, though the stipulated limit is around 3K.

I can guarantee that u r screwed for next 3+ years if it was EB2 and next 6+ years if it was EB3.
Well, go ahead and cry in the bathroom now instead of actively supporting IV.
My PD is Aug 2005. My employer by mistake sent the 485 application on June 27 and USCIS received on June 28. Today Aug 21, I received the rejected 485 full package back. Employer is following up whether it can sent back. Anybody has any idea of any luck in this case, or has to wait till dates are current again?

A little unrelated question but couldn't find the the right thread to post it...
What do you do if while traveling abroad, your GC is lost/stolen? Would the CBP officer at the airport allow you back in on the basis of a photocopy?

Honorable congressman,
I am writing to you (in your capacity as a judiciary committee member) to bring a recent action by the department of state that wrecked the hopes of many tax paying, employment based legal immigrants.
The New York Times carried an excellent editorial regarding the State department's actions:
http://www.nytimes.com/2007/07/07/opinion/07sat1.html
As a legal tax paying resident of Masachusetts since 10 long years, I have been eagerly waiting my turn in the line for a green card, putting lot of very important life decisions on hold. This latest bait and switch has made me totally disillusioned with the immigration system and I have started looking for opportunities to apply my skills in my home country instead.
For the sake of fellow legal immigrants who have been impacted though, I am hoping you can look into this matter and try to influence the department of state to correct its action. Rep.Lofgren has already issued a statement in this regard. http://lofgren.house.gov/PRArticle.aspx?NewsID=1808
Thank you for your time.
Regards,
xxxxxxx
Here is the link to the NY Times Editorial:
http://www.nytimes.com/2007/07/07/opinion/07sat1.html
It is one of the most well written editorials from a renowned source. (You might have to register to see it). Everyone should try to send emails via the above link to their own Senators and Congressman, along with various Congressmen on the House Judicial Committee (Subcommittee on Immigration). http://judiciary.house.gov/committeestructure.aspx?committee=4 .
The House.gov web site does not accept email from anyone outside their respective constituency. The Chairperson is from San Jose CA while the other members are from CA, VA, MA, TX, IL, etc. If you are from one of these places, you need to emphasize the importance to them and also mention that we are the next wealthy voting block of the future elections and we will remember them. Now only a Congressional oversight can save us from the USCIS created crisis.
