    I think, it is a combination of three things.
    1. Laziness
    2. No Accountability
    2. Bad intentions ...as you mentioned

    In my job, I am a software trainer. I teach hundreds of people. I will be accountable (and asked questions) if I delay my work even by one day. There are tight deadlines for everything. (Yes, 5 minute job of renewing EAD will not be 90 days ...it will be 5 minutes only) Even if one customer just soft complains about anything, I will be held accountable and my job will be in jeopardy. There is no such thing in USCIS.

    BTW: I hate when they say 90 days and then exclude the RFE time and the mail accepting time.(They count from the date of receipt and not the date of receiving the mail). On the top of it, the receipt date can be any time they want and not the date of receiving the date. It can become 120 days and when they say "days", it is like one of those commercials which says, " for only 1$ a day ...." instead of saying $365 which they charge for the whole year . subscription.

    Same way instead of saying 3 to 5 months , they say 90 days (so that it does not seem long). they should say , "EAD RENEWAL ONLY TAKES 129600 MINUTES". ..and then in the small print, light gray color at a hidden spot in the bottom, in tons of lines of text, say, "does not include RFE, holidays, Mail transit time, and time before we accept it"

    Can anybody please send me the address of USCIS director ? I want to write a letter to him with a copy to his boss too. Anybody can help me know who his boss is and his address too ?

    You will be barking up the wrong tree or up the same tree a lot of us have already barked up to, by writing to rthe Director of USCIS and his boss.
    Alejandro Mayorkas is the Director od USCIS and I believe his boss would be none other than Ms. Janet Napolitano..

    Poke around IV, there has to contact information for both of these individuals.
    Laziness and Un-accountability are hallmarks of any government organization in any country, so we can discount that. I strongly incline in the direction of "Bad Intentions".

    Afterall these are all clerk level employees who have, what amounts to the future of thousands of people, in their hands. Whenever USICS efficiency/operating procedures are discussed here, I am reminded of what a clerk in my engineering school in India once told me. Mind you, this was NOT a government office where dealinggs of millions of rupees are made. This was a SCHOOL.
    Following is the brief dialoge between the clerk and I:
    Clerk: "Bhai, clerk se hamesha dar ke rehna."

    Me" "Kyon?"

    Clerk:" KUTTA mein ek (one) "K" ( the hindi letter Ka), hota hai aur clerk mei 2, is liya dhyan rakha"

    That dude was so correct.

    AP is sent to the lawyer if you filed the G328

    Not always true, I've filed G-28 in my case, but received the AP at my residence address. Have friends/colleagues who had received AP at the attorney address. So it is kinda random. No logic behind this.

    It is important we get the document.

    The problem really was that IOs are not properly briefed on AC21. There are some cases where they have to ask their supervisors about it. What if the supervisors are also not familiar with AC21?

    As others are saying, IOs will soon gain more knowledge on AC21 as many will use it due to the retrogression. Until that time, it is risky.

    Did you change company? or filed AC-21.

    My PD is also close to yours and transfer is TSC-CSC-NSC

    I had LUD on 2/10....Lets hope for the best...I will keep you posted on my status

    No company changes, AC21 or anything out of the ordinary.

    Hi Folks,

    Here is my situation.

    My current working company - EB2- August 2002 - 140 is under processing....
    (receipt date for 140 is October 2007)
    (thanks to labor backlog center :mad: got stuck in backlog center for 5 years)

    With my friend's company - EB3 - April 2004 - 140 is under processing....
    (receipt date for 140 is July 2007) 485, EAD, AP filed and got them also.

    What all the options I have now? Which one will be better assuming both 140 gets approved.

    AILA and all the immigration lawyers and many employers threw a hissy fit when DOL wanted to shut down labor substitution.

    They lobbied hard at DOL to allow the continuation of labor substitution. IV has tried to get DOL to eliminate labor substitution or at least make it such that the Priority date is not the labor filing date but the 140 filing date. Allow labor sub with PD = 140 filing date will solve the problem of cutting in line and getting ahead in an unfair manner. QGA helped to get our message to Eliane Chow, The Secretary of Labor Department. (http://www.whitehouse.gov/government/chao-bio.html)

    Unfortunately, the secretary of labor didnt oblige.

    These immig lawyers and AILA bombarded DOL with requests in favor of labor sub.

    This is a very valid point. If employer or his lawyer asks more money in fees for filing I485 it is always better to go thro employer if he files I485 promptly. But if the delay is intention of the employer then use your own Lawyer.

    Desi companies - HIGHLY ADVISABLE TO USE UR OWN LAWYER AND DONT LINK LAWYER AND EMPLOYER - THEY HAVE TENDENCIES TO BECOME BUDDIES BASED ON BUSINESS PROMISES.

    TAKE ALL DOCUMENTS FROM EMPLOYER AND GIVE TO LAWYER. U MAINTAIN UPPER HAND WITH LAWYER.

    485 RFE IS COMMON FOR EMPLOYER- LAWYER COMBO OF DESI COMPANIES.

    Lawyer needs money and employer needs prolongation.

    With rules changing and with CIR reintroduction and with Durbin Grassley amendments - Desi companies will be having tough business in future - they will try to retain consultants in whatever way possible. So beware. These people are sweet in their talk - but they do everything opposite to what they talk.

    This maybe applicable to non desi companies also - this dates becoming current is an acid test for employer's genuinity.

    So be cautious - watchful and get things done in smart way. 180 days down the lane the story is different.

    Eagle,

    I have been reading all the valuable suggestions being provided to you by the senior and exisiting members of immigrationvoice.org. I feel your pain and frustation. I would like to point out a few things which no other member did so far for you:

    Your application has been denied. I am sure you have already filed an MTR unless its ready to go out in the mail. If you are lucky your MTR will get approved or it will be sent to AAO office which is taking roughly 18 months for a decision.

    My advice to you is to file a brand new I140 EB3 application along with your MTR as that will allow you to maintain your priority date and start a new I140 application. Consult my advice with your attorney and see if he agrees to what I suggested. If he does then he should not charge you a consultancy fee as that advice would have come from you not him.

    There is no way any credential evaluation agency can equate a Indian BCOM degree to Bachelors in Business Administration in USA. If you center was NSC they are known to deny cases such as yours. TSC is following their footsteps.

    In your appeal you need to concentrate on your Masters Degree as that was the requirement for your job profile on your LC.

    You need a strong lawyer in your case who can justify and question USCIS decision. Feel free to ask me any other questions related to my advice.

    FYI, I got my RFE today too and it is for the same exact thing as my wife's, which I shared yesterday below.


    I got LUD 2/17 and 2/18, same for my wife, 2/17 was RFE message, got my wife's RFE in mail today it was for a serological HIV test which was supposedly required but was not done.

    Have yet to receive my RFE yet, hopefully tomorrow.

    We are like beggars in this country. This country and its people do not want us here and are doing everything permissible under law to throw us out of here (if no law then they just make one up).

    But we are such suckers that we do not want to leave this country and go back home. Gandhi fought to get rid of white masters but we were destined to serve one anyway. I don't understand why I don't live in my own country and contribute to its economy. Why am I tolling so hard to live here? I don't know when will my hard head understand this silly concept.

    The reason is...probably we are not toiling that hard....As long as one has a paying job, things go reasonably smooth.....and we dont toil as much as it is made out to be.
    The issue comes only when one loses the job...and had to play catch-up with immigration to keep us in status.

    That is also the reason why you don't get mass participation in legal immigration activities.
    I presume people are just happy with the status-quo! They think of going that extra length only when that status quo gets disrupted..
